El presente documento pretende caracterizar la gestión (...) de la industria minera en el ámbito colombiano y su relación entre el accionar gubernamental y empresarial, lográndose esto a través de una revisión y análisis documental. El territorio colombiano se encuentra bastante desprotegido por el Estado, lo que ha generado fuertes repercusiones en el desarrollo de esta actividad en las áreas donde se ejecuta.As the economy advances, States are forced to update their means of production in order to generate competitive strategies that allow its foray into the sphere of the world market. One of these skills considered by Colombia, it has been the incursion of mining in many of its departments, which has generated a strong wave of investment both foreign and domestic to this economic sector. This document aims to characterize the management of the mining industry in Colombia and the relationship between government and business actions, this being achieved through a review and document analysis. Para llevar a cabo este trabajo, se utiliza un método hermenéutico, pues se hace un acercamiento dialógico y holístico a las obras del pensador argelino para descubrir su pensamiento respecto a Dios y a la felicidad humana. How do people understand the concepts of mental health and disorder? The objective of this paper is to examine the impact of several factors on people’s judgments about whether a condition constitutes a mental disorder or a healthy state. Specifically, this study examines the impact of the source of the condition, its outcome, individual valuation (i.e., the value the individual attaches to the condition), and group valuation (i.e., the value the relevant group attaches to the condition). While we find that (...) people’s health and disorder judgments are driven by perceived dysfunction, we also find that health and disorder judgments are impacted differently by these factors. Health judgements are impacted by outcome and individual valuation, and disorder judgments are impacted by condition source. These results suggest that the folk concept of mental health is positive (i.e., mental health is more than the absence of mental disorder) and normativist (i.e., value judgments play a significant role in determining whether a condition counts as healthy), while the concept of mental disorder aligns with a naturalist perspective, at least to the extent that dysfunction plays an important role in categorizing a condition as a disorder. However, our finding that people’s dysfunction judgments are influenced by individual valuation and outcomes poses a strong challenge to naturalist accounts. The Luck Problem has existed in one form or another since David Hume, at least. It is perhaps as old as Stoic objections to the Epicurean swerve. Although the general issue admits of different formulations with subtly different emphases, the characterization of it that will serve as my target focuses on “cross-worlds” luck, a kind of luck that arises when the decision-making of agents is indeterministic.

Qualitative studies on assisted reproductive technology commonly focus on the perspectives of participants living in major metropolises. In doing so, the experiences of those living outside major cities, and the unique way conditions of spatiality shape access to treatment, are elided. In this paper, we examine how location and regionality in Australia impact upon access and experience of reproductive services. We conducted twelve qualitative interviews with participants residing in regional areas across Australia. We asked participants to discuss their experience with (...) assisted reproduction services and the impacts of location on access, service choice, and experience of care, and analysed the data using reflexive thematic analysis, as outlined by Braun and Clarke (2006, 2019). Participants in this study reported that their location impacted the services available to them, required considerable time in travel, and reduced continuity of care. We draw on these responses to examine the ethical implications of uneven distribution of reproductive services in commercial healthcare settings which rely on market-based mechanisms. (shrink)

This article contributes to the limited literatures on small- and medium-size enterprises and corporate social responsibility. Using an institutional theoretical framework, we analyzed fieldwork interviews with twenty SMEs and perspectives of 165 SME managers and workers in textiles, garment, and footwear industries, the most important wage-earning sector in Vietnam. Having understood in the context of a developing “market economy with socialist orientation”, we find that socially responsible practices and expectations developed long before the arrival of CSR as a western concept (...) and an MNC agenda. While identifying and contributing ideas concerning forms of “informal” CSR practices—influenced by social and cultural expectations—to the CSR/sme literature, we are conscious of the mixed effects of these practices and the ongoing nuanced negotiations between workers and managers in these SMEs. In our research, we found that it takes both domestic and international stakeholders to improve labor conditions in Vietnam under the banner of CSR. (shrink)

Esta investigación presenta planteamientos fenomenológicos y hermenéuticos sobre el quehacer teológico en el contexto de la Universidad Católica Luis Amigó, en miras a la renovación del trabajo del pregrado definido como una Teología en contexto. Se buscó comprender en qué consiste tal quehacer teológico porque así lo requiere la carrera en los actuales marcos de comprensión socioeclesial, además de las definiciones institucionales dentro de la Universidad. Para esta comprensión, junto a la revisión de los aportes históricos, filosóficos y teológicos en (...) general, se hizo necesario plantear una metodología cualitativa que incluyó, a partir de la técnica del grupo focal, la experiencia de estudiantes y maestros que entienden, fraguan y asimilan este conocimiento teológico-contextual al interior de las aulas de clase. Así se da cuenta del mundo de la vida y de la interpretación del acto de vida, donde se hacen las construcciones teológicas. Finalmente, se comparte el análisis y discusión de los resultados con el propósito de aportar horizontes desde y para la institución, con el fin de facilitar una Teología al servicio de las comunidades y de la sociedad colombiana. As an independent researcher, registered social worker and erstwhile long-term, long-distance carer, the care of older people and protection of elders from abuse had been constant professional and personal foci for me for many years. Commissioned to review a case involving the serious abuse of an elder where official safeguarding procedures had not been used, I puzzled why this had been managed ?informally? by social services and partner agencies (i.e. outside adult safeguarding procedures), with vague unspecified ?monitoring? (AEA 2006). Why (...) was there this apparent gap between policy intention and implementation? That question led to research on which this essay is based. (shrink)

ABSTRACT This cross-sectional study compared the moral reasoning of first-year and third-year doctoral students in clinical psychology. Nineteen first-year and 20 third-year students were recruited from 17 doctoral training programs in the UK. Most adopted a sophisticated approach to moral judgments, as assessed by the Defining Issues Test, although, surprisingly, more experienced students had significantly less sophisticated schemata. In their moral judgments, less experienced students relied more heavily on their personal, and more experienced students on their professional, constructs, as assessed (...) by repertory grid technique. A satisfactory construal of the subject matter of free will debates must allow for disagreements along two axes. First, it must allow for the possibility of higher order disagreements, or disagreements about what concepts, phenomena, or practices an account of free will is supposed to capture or explain. Second, it must allow for the fact of variation in the extent to which theories are bound by antecedent pre-philosophical thought, talk, and practices. A promising way of accommodating these two thoughts is (...) to treat free will in broadly functionalist terms. On the account proposed here, free will is a power that makes sense of everyday responsibility practices. This construal is not widely shared, but it allows for the possibility that we might have false beliefs about the nature of free will, while still making sense of central philosophical debates about free will. Despite the fact that their disagreement concerns the most basic metaethical and metaphysical questions regarding our relation to nature, it has become apparent that many anthropocentrists share with nonanthropocentrists a concern for the environment for its own sake, that is to say, a noninstrumental concern for nature. This concern is also present in practical spheres of environmental engagement. With regard to the philosophical task of justifying the claim that we ought to protect nature, this concern imposes on those that share (...) it at least three conditions: priority, independence of future interaction, and universality. Reasonably specified, these conditions are neutral between anthropocentrism and nonanthropocentrism and should be attractive to both camps. Although there are reasons to think it would be difficult to meet all three conditions at the same time, with some modification a promising way to do it becomes apparent. (shrink)

This book chronicles the influence of second wave feminism on everything from electoral politics to LGBTQ rights. The original descriptions of second wave feminism focused on elite, white voices, obscuring the accomplishments of many activists, as third wave feminists rightly criticized. Those limited narratives also prematurely marked the end of the movement, imposing an imaginary timeline on what is a continuous struggle for women’s rights. Within the chapters of this volume, scholars provide a more complex description of second wave feminism, (...) in which the sustained efforts of women from many races, classes, sexual orientations, and religious traditions, in the fight for equality have had a long-term impact on American politics. These authors argue that even the “Second Wave” metaphor is incomplete, and should be replaced by a broader, more-inclusive metaphor that accurately depicts the overlapping and extended battle waged by women activists. With the gift of hindsight and the awareness of the limitations of and backlash to this “Second Wave,” the time is right to reflect on the feminist cause in America and to chart its path forward. The discovery of Neptune was one of the greatest achievements of nineteenth-century astronomy. Using nothing but calculus and some observations of the Uranus’ anomalous motion, Adams and Le Verrier got to determine, independently, the possible place and mass of a hypothetical planet, which would produce its observational discovery. In this paper I will demonstrate that the methods used by these astronomers were influenced by Newton’s method of analysis and synthesis. Considering this, I will also expose, that some astronomy’s general epistemological (...) principles could be deduced when we consider these investigation methods. (shrink)

This study examines the practices of Equine Assisted Therapy and Learning in Australia. Among Equine Assisted Therapy and Equine Assisted Learning centers there is a large degree of variation in practice worldwide. The current study outlines a range of practices in two states in Australia whereeatandealhave arisen and evolved from models developed elsewhere. The philosophical foundations, training and certification processes followed along with the types and training of horses involved are compared across facilities. The findings of the study illustrated the (...) large variation ineatandealin current practice in Australia. The results suggested that if the practices ofeatandealare to move out of the “fringe” of mental health and learning professional practice and into the mainstream, their theoretical underpinnings, certification and licensure procedures, and methodology of practice must become more clearly defined. Grief is often described as characterized by a particular emotional response to another person’s death. While this is true of paradigm cases, we argue that a broader notion of grief allows accommodating forms of this emotional experience that deviate from the paradigmatic case. The bulk of the paper explores such a nonparadigmatic form of grief, anticipatory-vicarious grief, which is typically triggered by pondering the inevitability of our own death. We argue that AV-grief is a particular moral emotion that serves a (...) unique function and is indissolubly linked to the practical identities of human agents. An agent’s AV-grief is about the harm that occurs to individuals whose practical identities depend on the agent. (shrink)

Nomy Arpaly rejects the model of rationality used by most ethicists and action theorists. Both observation and psychology indicate that people act rationally without deliberation, and act irrationally with deliberation. By questioning the notion that our own minds are comprehensible to us--and therefore questioning much of the current work of action theorists and ethicists--Arpaly attempts to develop a more realistic conception of moral agency.

In a recent article in Sociology, Diane Richardson contends that rather than focusing on theorizing the specific relationship between sexuality and gender, researchers should focus on developing frameworks that capture the complex and dynamic nature of that relationship. Towards that end, Richardson proposes ‘patterned fluidities’ as a working metaphor for feminine sexuality. This article explores the potential of the metaphor as a focal point for bringing together different strands of feminist thought on heterosexuality. It discusses if and how ‘patterned fluidities’ (...) are supported by empirical evidence and how they interact with areas of thought that do not fall within the scope of Richardson’s article, namely feminist views on postmodernity. The concept of “philosophical normalization” has become common place, recently questioned in the narrative of the historical process of philosophy in Latin America. From the theory of layers of time raised by R. Koselleck this paper proposes a critical review of this concept.

Authenticity has become a widespread ethical ideal that represents a way of dealing with normative gaps in contemporary life. This ideal suggests that one should be true to oneself and lead a life expressive of what one takes oneself to be. However, many contemporary thinkers have pointed out that the ideal of authenticity has increasingly turned into a kind of aestheticism and egoistic self-indulgence. In his book, Varga systematically constructs a critical concept of authenticity that takes into account the reciprocal (...) shaping of capitalism and the ideal of authenticity. Drawing on different traditions in critical social theory, moral philosophy and phenomenology, Varga builds a concept of authenticity that can make intelligible various problematic and potentially exhausting practices of the self. In virtue of their capacity for political agency, political agents can possess special rights, powers, and responsibilities, such as rights to political participation and freedom of speech. Traditionally, political theorists have assumed that only cognitively unimpaired adult humans are political agents, and thus that only those humans can be the bearers of these rights, powers, and responsibilities. However, recent work in animal rights theory has extended the concept of political agency to nonhuman animals. In this article, I develop an account (...) of political agency that identifies the capacities that one must possess to be a political agent and captures the fact that political action is a distinctive type of action. Crucially, this account makes sense of the standard assumption that only some humans count as political agents, and explains why few nonhuman animals, human infants, and severely cognitively impaired humans are likely to possess the capacity for political agency. I go on to reject the view, recently advanced by Sue Donaldson and Will Kymlicka, that nonhuman animals can be ‘nonintentional political agents’. I conclude by suggesting that most nonhuman animals, as well as human infants and humans with severe cognitive impairments, cannot straightforwardly be assigned rights to political participation. Este trabajo propone explicar, a partir de la metodología propuesta por la Comisión Europea en el “Manual para la Perspectiva de género”, por qué las mujeres rurales víctimas del conflicto armado en Colombia se constituyen como un grupo especialmente vulnerabilizado y cuáles son las principales barreras a las que se enfrentan al momento de reclamar su derecho a la restitución de tierras, específicamente en los programas que se vienen desarrollando en el marco de la Ley 1448 de 2011.

An experience of helplessness during the production of a collective autobiographical narrative offers an opportunity to explore points of convergence between Adriana Cavarero's postural philosophy and Bracha Lichtenberg Ettinger's matrixial borderlinking. The narrative is treated as a live scene that enfolds the movement of the drive conceptualized in such a way as to avoid the prioritization of death over life. Five successive moves, inspired by Ettinger's rotation of the phallic prism, illuminate affinities between the two thinkers. The first rotation explores (...) the matrixial and relational qualities that compose the scene. The second rotation approaches death from a notional beginning, prioritizing the presence of the mother and her assymmetrical relationship to the infant. The third rotation emphasizes the transformational character of Ettinger's matrixial movement and border-crossing, especially when examined in conjunction with Cavarero's maternal inclination. In the fourth rotation we show how inclination in Lacanian psychoanalysis is linked to the disappearance of the mother from the scene. The introduction of the mother disrupts the Lacanian logic with the possibility of a beginning just as immanent as desire and lack. Movement, qua embrace and unity-disunity, becomes an indispensable component of feminist ontology that captures the immanence of sharing in the matrixial-maternal plane. (shrink)

In this article, we develop and defend an account of the normative significance of nonhuman animal agency. In particular, we examine how animals’ agency interests impact upon the moral permissibility of our interactions with them. First, we defend the claim that nonhuman animals sometimes have rights to self-determination. However, unlike typical adult humans, nonhuman animals cannot exercise this right through the giving or withholding of consent. This combination of claims generates a puzzle about the permissibility of our interactions with nonhuman (...) animals. If animals sometimes have rights to self-determination, but lack the capacity to consent, then when, if ever, is it permissible for us to touch them, hold them, bathe them, or confine them? In the second half of the article, we develop a solution to this puzzle. We argue that while we cannot obtain animals’ consent, they can engage in authoritative communications of will through acts of “assent” and “dissent.”. (shrink)

RESUMEN Este trabajo pretende analizar el papel jugado por la ideología en lo que respecta al despliegue histórico de los derechos humanos, interrogándose sobre si dicho despliegue ha cumplido con una función eminentemente ideológica. La reflexión transcurrirá a través de la visión de dos pensadores que han mantenido una de las discusiones filosóficas contemporáneas más interesantes: Louis Althusser y Michel Foucault. En un primer momento, se esbozará la teoría althusseriana de la ideología, con el fin de sostener que los derechos (...) humanos han operado como un "aparato ideológico", interpelando al individuo desde un contexto inmanentemente capitalista. En un segundo momento, comprobaremos que Michel Foucault fue muy crítico con los planteamientos althusserianos. La noción de sujeto trascendental será crucial en dicha crítica, puesto que en la perspectiva foucaultiana nunca existen sujetos constituidos con anterioridad a las tramas de poder efectivas. En el análisis foucaultiano, la ideología dejará de ocupar un lugar esencial. Las aportaciones de Slavoj Žižek también resultarán, por cierto, determinantes en toda esta discusión. Finalmente, se trazarán algunas reflexiones criticas para pensar la posibilidad emancipadora de los derechos humanos en el mundo contemporáneo. ABSTRACT This paper intends to analyze the role played by ideology in regard to the historical implementation of human rights, questioning whether this implementation has fulfilled an eminently ideological function. The reflection will pass through the vision of two scholars who have held one of the most interesting contemporary philosophical discussions: Louis Althusser and Michel Foucault. At first, the Althusserian theory of ideology will be outlined, in order to defend that human rights have operated as an "ideological apparatus", questioning the individual from an immanently capitalist context. Then, we will verify that Michel Foucault was very critical of the Althusserian approaches. The notion of a transcendental subject will be crucial in such criticism, since in the Foucaultian perspective there are never subjects that are constituted prior to effective dynamics of power. In Foucaultian analysis, ideology will no longer occupy an essential place. The contributions of Slavoj Žižek will also be, by the way, decisive throughout this discussion. Finally, some critical reflections will be drawn to think about the emancipatory possibility of human rights in the contemporary world. (shrink)

Austerity in Greece resulted in poverty, political and social turmoil and intense debates about collective identities, citizenship and the future. One of the main arguments has been that the Greeks should re-evaluate their relationship with the past and their over-reliance on national narratives. The task of re-evaluation can only be accomplished in the public spheres of politics and culture, where individual and collective voices gradually transform the imaginary significations that animate the social body. One such voice is Rhea Galanaki, a (...) novelist with a long and distinguished presence in Greek and European literature. The present article draws on her 2015 novel I Akra Tapeinosi in order to flesh out a feminist political vision for the future. This vision draws inspiration from women’s struggles against patriarchy in past decades, and resonates with the concepts of vulnerability and care, contributing to thinking a compassionate alternative to the politics of despair within and beyond the Greek borders. A large part of the contemporary literature on dehumanization is committed to three ideas: (a) dehumanization involves some degree of denial of humanness, (b) such denial is to be comprehended in mental terms, and (c) whatever exact mechanisms underlie the denial of humanness, they belong in the realm of post-perceptual processing. This chapter examines (c) and argues that the awareness of minds might belong to perceptual processing. This paves the way for the possibility that dehumanization might, at least in part, (...) be a perceptual phenomenon, such that dehumanizers visually perceive the dehumanized as exhibiting lesser-than-human minds. It is perhaps unsurprising that the first systematic investigations of dehumanization approached the phenomenon as linked to contexts of war, genocide, extreme hatred, and violence. One guiding hypothesis was that dehumanizers exclude the dehumanized from a moral community of human beings, implicitly conceptualized as displaying distinct individualities and being embedded in caring interpersonal relations. By comprehending the dehumanized as deindividuated entities to which moral norms and considerations of fairness do not apply (Opotow 1990), dehumanizers are able to disengage from moral restrictions and self-sanctions (Bandura 1999). Neil Levy (2007) argues that empirical data shows that psychopaths lack the moral knowledge required for moral responsibility. His account is intriguing, and it offers a promising way to think about the significance of psychopaths for work on moral responsibility. In what follows we focus on three lines of concern connected to Levy's account: his interpretation of the data, the scope of exculpation, and the significance of biological explanations for anti-social behavior.

Cognitive theory (CT) is currently the most widely acknowledged framework used to describe the psychological processes in affective disorders like depression. The purpose of this paper is to assess the philosophical assumptions upon which CT rests. It is argued that CT must be revised due to significant flaws in many of these philosophical assumptions. The paper contains suggestions as to how these problems could be overcome in a manner that would secure philosophical accuracy, while also providing an account that is (...) better suited to explaining some of the cognitive, emotional, and bodily manifestations of affective disorders.
